Terms & Conditions

By booking at stay at the Bar SZ Ranch, you are agreeing to all the terms and conditions below and completing a general liability waiver on behalf of you and your group. Please read thoroughly.

Check-In / Check-Out Policies
This property has the following check-in and check-out times and policies.

Check-In: 4:00 PM
Check-Out: 11:00 AM

Go straight to your accommodations upon arrival. Your house will be unlocked and ready for you at 4pm PST (no early check-ins permitted). We do not have a front desk.

Property and Cancellation Policies

Cancellation Policies
- 100% refund up until 60 days prior to arrival
- 50% refund up until 30 days prior to arrival

If the guest arrives and decides to leave early, the nights not spent are non-refundable.
If the guest arrives after their scheduled check-in day, the nights not spent are non-refundable.
In case of a “no-show”, the total price of the reservation will be charged and is non-refundable.

All cancellations are confirmed via email immediately after the reservation has been cancelled.

Payment & Terms at Check-in, Check-out
We will process your payment immediately after receiving your reservation. Please note, your booking has not been made or verified until you receive a confirmation email from relax@barszranch.com

You can check-in anytime after 4PM PST. Houses will be available and unlocked upon your arrival, so please follow the directions straight to your accommodations (no front desk or check in service provided).

You can check out up until 11AM PST. We do not accommodate late check-outs. An additional $250 late check-out fee will be charged if guests leave the rental after 11AM PST.
Please note that a more detailed inspection of your accommodation is usually made after the check-out time, and we reserve the right to charge for any damages, breakages, or missing items found before the room/apartment is occupied again. If you leave any items behind after your stay, a minimum $25 fee will be assessed to cover shipping costs to you.

The standard booking price includes the following:

- All taxes
- All housing amenities and facilities as mentioned on our website

Cleaning Fees
The associated cleaning fee will be charged during booking:
The Ranch House Cleaning Fee: $350
The Log Cabin Cleaning Fee: $200

Additional Cleaning/Damage Fees (if applicable)

Please do not take blankets, pillows, and towels outside and place on the ground

Guests can be charged an additional cleaning fee ($50/hour of cleaning time) if guests do not do follow the cleaning procedures below prior to checkout (11am):
- If guests do not thoroughly wash all dishes and place them in the drying rack or dishwasher- If guests do not put back all furniture as it was prior to check-in
- If items such as furniture, kitchenware, utensils, towels, pillows, blankets and/or sheets are damaged or missing from their designated accommodations, guests will be charged in order to replace missing or damaged item(s).
- Please do NOT strip the beds
- The bed linens, towels, and all other items are NOT gifts and should remain in the houses.
- All condiments, toilet paper, seasonings, spices, coffees, and teas are NOT gifts to take home with you and need to remain in the accommodations.

Smoking Policy
‍
In our houses, smoking is not allowed. Due to fire concerns in our area, it is very important that those who wish to smoke stay in the designated areas only (NOT allowed in houses). There are designated areas on site that staff can direct you to if you choose to smoke during your stay. If guests are caught smoking outside of the designated areas, guests will be asked to leave the ranch immediately and will not receive a refund of their reservation. If guests do not pick up their cigarette butts in the designated smoking areas, a $10 fee will be charged for every butt not disposed of properly.

Houses Policy

We want you to have a great time when you are here. But if things get too crazy, we go by the old-school rule of ‘you break it, you buy it,' and amounts for property damages or missing items will be charged. Pre-existing damages or house issues must be reported to the on-site staff immediately upon arrival to avoid responsibility and potential charges.

Ranch Curfew
Sing your heart out, and have passionate conversations all day long, but curfew is 10:00 p.m. to 8:00 a.m. The ranch is to remain quiet during the night for consideration of all guests.

Privacy Policy

When you visit this website you may provide us with information such as personal information you knowingly choose to disclose that is collected on an individual basis. The security of your personal information is important to us. When you enter sensitive information, like credit card numbers, on our website, we encrypt that information using secure socket layer technology (SSL). When credit card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete credit card details. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

Bar SZ Ranch Participant Release of Claims and Waiver of Liability

In consideration of the services offered by Bar SZ Ranch I agree as follows:

1. Inherent Risks
I acknowledge that the following describes some, but not all, of the risks that I might encounter while at the BAR SZ Ranch or while participating in activities at or through the ranch. I acknowledge that Bar SZ Ranch is a rustic country style guest ranch. I acknowledge that guest ranches with activities like horseback riding, shooting guns, hiking in the wilderness, feeding and caring for animals, swimming or creek walking, and numerous other pastimes entail known, unknown and unanticipated risks that could result in physical or emotional injury, DEATH, or damage to myself, to property (including my animals) or to third parties. I understand and acknowledge that the enjoyment and excitement of this type of activity is derived in part from inherent risks created by activity beyond the accepted safety of life at home or in my normal day to day activities and that these inherent risks contribute to my enjoyment and excitement and are an integral reason for my participation in this activity.I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activities of the guest ranch experience.

I specifically acknowledge that horseback riding and standing near horses is a HAZARDOUS ACTIVITY, and there are numerous obvious and non-obvious inherent risks always present in such activities despite all safety precautions. I acknowledge being advised that horseback riding ranks highly among the activities in which participants have severe fall injuries that result in a hospital stay. These injuries can be severe, requiring more hospital days and resulting in more lasting residual effects than injuries in other activities, including the possibility of DEATH. I also understand and acknowledge that failing to use or properly use safety equipment such as protective headgear, increases my risk of injury or of not surviving an accident or incident while horseback riding. I understand and acknowledge that if a horse is frightened or provoked it may divert from its training and act according to its natural survival instincts which may include, but are not limited to: stopping short; changing directions or speed at will, shifting its weight, bucking, rearing, kicking, biting, or running from danger. I understand that riders should not carry loose items while riding (toys, purses, hats not fastened securely) that may fall, blow away, flap in the wind or make sharp noises that could frighten the horse. Riders should not yell or scream or make other sharp noises that could scare the horse. I understand and acknowledge that saddle girths (saddle fasteners around the horses belly) may come loose and cause saddle slipping. I understand and acknowledge that, upon mounting a horse and taking up the reins the RIDER is in primary control of the horse; as such, my safety as the rider depends upon my ability to carry out simple instructions and upon my ability to remain balanced aboard the moving animal. I also understand and acknowledge that BAR SZ is NOT responsible for acts, occurrences or elements of nature (for example, thunder, lightening, rain, wind, wild and domestic animals, insects or reptiles that may run, fly near, bite and/or sting a horse or person and/or irregular footing that can scare a horse, cause it to fall or cause it to react in some other unsafe way. I agree and acknowledge that the term HORSEBACK. RIDING OR RIDING herein refers to riding, handling or approaching horses, whether from the ground or while mounted on the animal. The term RIDER shall herein refer to a person who rides a horse mounted or otherwise handles, grooms or comes near a horse from the ground.

I acknowledge that hunting, use of firearms (guns) and/or clay target or skeet shooting are HAZARDOUS ACTIVITIES that have inherent risks that include, but are not limited to my own handling of the firearm and being near others that are handling firearms, the risk of ear injury from the noise associated with discharging the firearms. I specifically acknowledge that I can be injured or KILLED by the ammunition, the clay targets or a shot from another’s’ use of the firearms.

I acknowledge that I may choose to participate in other activities/pastimes while at the BAR SZ Ranch, each of which will have its own known, unknown and unanticipated risks that could result in physical or emotional injury, death, or damage to myself, to property (including animals owned by me or my guests), or to third parties. A few examples of such activities being in the vicinity of or interacting with horses or other animals, hiking, wagon rides, campfires, horseshoe games, archery, motorized off-road vehicles, swimming or creek walking, etc., each of which has elements of risk.

I acknowledge that BAR SZ Ranch is in a remote wilderness location with many potentially hazardous conditions.Participants may experience extreme environmental and/or weather conditions, such as lightning, hail, heavy rain, snow, strong wind and thick fog. Exposure to the natural elements can be uncomfortable and/or harmful and I am aware that this exposure could cause sunburn, dehydration, heat exhaustion, heat stroke, heat cramps, frost bite or fatigue, some or all of which may diminish my or the other participants ability to react or respond. I understand that horses, cattle, goats, rabbits, dogs, cats, chickens, turkeys and many other wild and domesticated animals are at the ranch and that they can easily be spooked by people which may cause them to step on, fall on, kick, bite or chase people, which may result in serious injury or DEATH. Participants may encounter dangerous wildlife, such as wild boar, mountain lions, reptiles (such as rattlesnakes) and biting insects which may result in serious injury or DEATH. I understand that the areas in which I might hike sometimes hide dangerous obstacles such as deep water in creeks or ponds which are a drowning hazard, barbed wire fences, holes in the ground, tree wells, tree stumps, rocks and boulders, forest dead fall, etc. I acknowledge I (and animals owned my me or my guests), may encounter firearms or substances necessary to the control of animals or insects. Delays or inconvenience because of inclement weather can occur. Communication in the terrain used by BAR SZ for its activities can be difficult and in the event of an accident, rescue and medical treatment may not be immediately available.

I specifically acknowledge that, in the event I choose to consume alcohol during my trip, I will bear complete responsibility for myself and for any damages or injury to others I may cause to BAR SZ, its property or to other guests.

I acknowledge that BAR SZ is not a Common Carrier but rather is in the guest ranch business. Transportation to and from activities is incidental to the activity. Transportation in some instances may be provided by BAR SZ and may involve errors in judgment by BAR SZ or staff operating the transport vehicles. The vehicles and transport trailers may malfunction, breakdown or be poorly maintained, causing injury, accidents, delays or in the extreme case, DEATH. Transport may be provided by independent contractors to BAR SZ and may involve errors in judgment by those independent contractors.

I acknowledge that I may choose to participate in activities that are provided by other vendors or operators over which BARSZ has no control. Those activities are incidental to the activities provided by BAR SZ and may involve errors in judgment by the other vendors and operators for which BAR SZ can bear no liability.

I acknowledge that my time at the BAR SZ Ranch may require me to use equipment that I might not be familiar with and will require me to interact with other guests and participants with whom I am also unfamiliar; any of these things can cause my discomfort and stress and have inherent risks. I acknowledge that there are numerous other issues I may encounter, such as campfire, ranch animals, wild animals, reptiles and insects, while they seem open and obvious, also have inherent risks associated with them.

By signing this agreement, I acknowledge that I AM ULTIMATELY RESPONSIBLE for my own safety during my stay at the BAR SZ Ranch. Furthermore, BAR SZ support staff have difficult jobs to perform. They prioritize safety, but they are not infallible. They might be ignorant of a participant’s fitness or abilities. They might misjudge the weather, the elements, or the terrain. They may give inadequate warnings or instructions and/or I as the participant may fail to understand the safety directions due to language issues.

2. Express Assumption of Risk
As lawful consideration for being allowed to participate in activities offered by BAR SZ, I expressly agree and promise on behalf of myself and any of the children for which I am responsible, to accept and assume ANY AND ALL RISK OF INJURY OR DEATH, and damage to property (including my animals), arising from such activities or otherwise in connection with my visit to the ranch. My/our participation in this activity is purely voluntary, and I/we elect to participate in spite of the risks.

3. Personal Skill & Insurance
I certify on behalf of myself and any of the children for which I am responsible that I/we have sufficient skill and fitness to participate in the activities I choose to participate in at BAR SZ Ranch. I further certify that I/we have no medical, mental or physical conditions which could interfere with my/our safety or ability to participate in these activities, or else I/we are willing to assume and bear the cost of all risks that may be created, directly or indirectly, by any such condition. I/we further certify that I/we have adequate insurance to cover any injury, damage or emergency transportation or search and rescue costsI/we may cause or suffer while participating, or else agree to bear the costs of such injury, damage or emergency transportation costs ourselves.

4. Medical Issues
I agree on behalf of myself and any of the children for which I am responsible that, in the event that BAR SZ deems it necessary to administer emergency first aid or CPR or to remove me/us from its activities or premises or from the field or to seek emergency medical care for me/us that, by signing this document, I/we are giving BAR SZ permission to: administer emergency first aid or CPR, secure emergency transport or medical care and/or disclose any medical information it may have about me/us to any health care provider which may become involved in my/our care, treatment or removal from the ranch. By signing this agreement I/we are waiving any right to object to or bring any type of action or claim against BAR SZ for its administration of emergency first aid or CPR or for securing emergency transport or medical care and/or for the disclosure of personal medical information it may have about me/us to any health related person who becomes involved in my/our care or removal from BAR SZ activities.

5. Photographic Assignment
I understand that BAR SZ reserves the right to take photographs or video of any or all of its activities and on behalf of my self and any of the children for which I am responsible. I/we hereby agree that BAR SZ may use such records for promotional and/or commercial purposes without any remuneration to me. I/we hereby assign all right, title and interest I/we may have in or to any and all media in which my name or likeness might be used by BAR SZ.

6. Release as Contract and Personal Capacity
On behalf of myself and any of the children for which I am responsible I expressly agree and acknowledge that the terms and conditions of this agreement are contractual in nature and that I/we are signing it of my/our own free will. I/we expressly acknowledge that I/we are not under the influence of drugs or alcohol at the time of my/our signing of this document and that there are no other impediments or reasons why I/we would lack the capacity to enter into this contract with BAR SZ.

7. Ranch Rules
I acknowledge that I /we will abide by the Ranch Rules attached hereto as Appendix A and failure to do so may result in property damage, serious injury or DEATH. [ ]

8. Indemnity, Discharge, Release, Waiver of Rights Including Claims of Negligence
I HEREBY INDEMNIFY, RELEASE, AND DISCHARGE Bar SZ Ranch, LLC, and Promise Land 1926, their owners, officers, directors, agents, employees, interns, volunteers, contractors, advisors, representatives and agents thereof, and each of them (collectively “Bar SZ Ranch Members”), from all actions, claims, expenses or demands I, my parents, my heirs, distributes, Guardians, legal representatives, or assigns now have or may hereafter have for injury or damage resulting from the activities and hazards conditions described herein, my failure to abide by the Ranch Rules in Appendix A, or my/our useof BAR SZ’s equipment or facilities, including any such Claims which allege NEGLIGENT acts or omissions of BAR SZ.

I hereby specifically and freely waive any and all rights I/we may have under California Civil Code §1542, which states: A general release does not extend to claims, which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.

9. Miscellaneous
This agreement shall be governed in all respects by the laws of the State of California as they apply to agreements entered into and to be performed entirely within California between California residents, without regard to conflict of law provisions.You agree that any claim or dispute you may have against Bar SZ Ranch or Bar SZ Ranch Members must be resolved by a court located in San Benito County, California. You agree to submit to the personal jurisdiction of the courts located withinSan Benito County, California for the purpose of litigating all such claims or disputes.

It is your obligation to read these rules and explain them to your family, children, and guest(s).

General Rules
1. Smoking is prohibited except in designated areas. Smoking is absolutely prohibited in the barns, riding arenas, commonarea, shooting range, and buildings. Fireworks are strictly prohibited.

2. Please stay away from dangerous wildlife, such as rattlesnakes and wild boar. If you see one, do not approach it, calmlyback away and notify a staff member immediately.
‍
3. Drink plenty of water, this area is extremely dry and hot and we advise you keep hydrated.
‍
4. Please do not bring any personal pet(s) to the stables or near our animals, you are responsible for their safety.
‍
5. Do not enter any stalls, paddocks, or arenas without a staff member.
‍
6. Many horses are not accustomed to strangers and/or children. For your protection, do not pet horses unless you are accompanied by a Bar SZ Ranch staff member.

7. Never tease or abuse an animal.

8. Do not feed the horses unless supervised by a staff member. Fingers look a lot like carrots!

9. Bar SZ Ranch has animals other than horses. Petting any of these animals is at the individual’s risk. Instinct due to fright or perceived danger may cause the animal to react accordingly.

10. Climbing or playing in or on hay bales, fences, or any gate is prohibited. Please stay out of all restricted areas for your safety.

Horseback Riding Rules
1. Everyone must sign a release of liability before they may be permitted to ride.

2. Safety is our number one concern. A safety demonstration will occur before each ride. Please be on time to your riding appointment so that you do not miss this important information. ONLY participants who can listen to the safety demonstration and follow directions will be allowed to ride on their own. Children or participants who are unable to follow directions may be required to have a "leader" (someone who walks next to the horse to ensure the rider's safety).

3. Please wear close-toed shoes and long pants when riding.

4. Please remember to wear sunscreen, sunglasses, hats, and water.

5. Please do not wear loose flowing clothing, backpacks, purses, loose water bottles, or large cameras. Anything that blows in the wind can cause a horse to spook.

6. In order to ride by themselves or participate in trail rides, children must be able to follow directions, properly steer, and know how to stop a horse.

7. Safety helmets are required while riding. Helmets that meet the ASTM Equestrian Standard are available to all riders. Each rider will learn to ride and guide their horse before any ride begins. Our instructors will ultimately determine the type of ride that will take place in order to keep everyone safe.

8. Many phones placed in pants pockets have been lost on the trail, we are not responsible for lost items.

9. No eating or chewing gum while riding.

10. Please wait for instructions before helping with any of the horses. We are concerned about your safety and will make sure that your interactions with our horses are fun and safe.

11. Horses should only be tied in designated areas. They should never be tied to stall doors, and should only be tied using their halter (not with a bridle or any other such tack).

Shooting Rules
1. Everyone must sign a release of liability before they may be permitted to shoot.

2. Ear and eye protection must be worn at all times by shooters, spectators, and personnel.

3. Never point a firearm at or near another person.

4. At all times firearms must be unloaded with action open or placed in a rack with action open. A shooter may only load his or her firearm when safely within the designated shooting station and only when preparing to shoot.

5. At no time will a shooter load more than two shot shells in a shotgun.

6. Practice swings behind any stand are not allowed. All shooters must maintain muzzle control.

7. Upon completing a course of fire and before stepping away from the station, all shooters are required to unload their firearm and open the action so that all may view the weapon is empty. All shooters are responsible for muzzle control and for keeping weapons pointed down.

8. NO ALCOHOL IS ALLOWED AT ANY TIME AT THE SHOOTING RANGE, ANYONE WHO HAS BEEN DRINKING WILL NOT BE PERMITTED AT OR NEAR THE SHOOTING RANGE.

9. All youth shooters, age 17 and under, must be accompanied by an adult.

10. Always keep your finger off the trigger until ready to shoot.

House Rules
‍
1. Dogs are not permitted onsite.

2. The cleaning fee does not cover dirty dishes, rearranged furniture, cigarette butts, etc. Please leave the ranch and your house as you found it. Additional cleaning time will be $50/hour.

3. Please read the welcome kit upon arrival. You are visiting a working ranch with real dangers on the property and many areas that are off limits.

4. Please do not rearrange furniture in the house. If you need to make room for a special event please contact a staff member who will arrange to move the furniture.

5. Please do not take furniture outside onto the deck or patio. If you need outside tables and chairs please contact a staff member.

6. Please do not take blankets or any other linens outside. Please bring your own blankets if you'd like to sit outside on the ground.

7. Please do not jump on beds, couches or any other furniture.

8. Please help us conserve energy by turning off AC/Heat when you leave the house. We reserve the right to shut off the system if you leave it running while away from the house.

9. We have limited drinking water; please conserve your usage of water.

10. Please do not try to fix anything that breaks or malfunctions. Our on-site maintenances available 24/7 to handle these situations. Please notify a staff member immediately of any problems you are having with the houses.

11. Please open the windows in the evening to cool off the houses, this will help conserve energy and give the AC a rest. Please Do Not open windows while the AC is running.

Swimming Pool Waiver and Release of Liability Form

Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement
PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

To: BAR SZ RANCH, LLC (the "Ranch", Owner of Property, Releasees)

I, along with each member of my party, (the "Releasors") wish to utilize the pool, pool facilities including areas surrounding the pool, including but not limited to, swimming at the Ranch’s pool facility during the length of our stay. By swimming in the Ranch pool, I, including each of the Releasors, recognize and fully understand certain things, including:
‍
• At no time is there a lifeguard on duty, you (the renter) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay.
‍
• My use of the pool facilities during my stay involves certain risks, including but not limited to:

1. The risk of injury resulting from possible malfunction of the pool equipment;
‍
2. The risk of injuries resulting from tripping or falling over obstacles in the pool area;
‍
3. The risk of injuries resulting from unsupervised divers and swimmers colliding;
‍
4. The risk of other injuries resulting from participating in any action in the pool.

• I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming.

In exchange for the Owner allowing me to utilize the pool and area during my stay, I. along with the Releasors, hereby agree to the conditions below: I, along with the Releasors, fully intend and choose to give up the legal rights, as stated below:

1. TO WAIVE ANY AND ALL CLAIMS that I, or the Releasors, have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the (“Releasees”) relating to my use of the pool and pool area;

2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES;

3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area

4. That I am over the age of 18 and that I am responsible for my entire party and will adhere to all the rules of the property including ensuring my party does the same;

5. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate.

By agreeing to the terms and conditions, I acknowledge for myself and for every adult and child in my group that if anyone is hurt or property is damaged during my participation in any activity or in any way connected to my visit at the ranch, I/we may be found by a court of law to have waived my/our right to maintain a lawsuit against BAR SZ on the basis of any claim from which I/we have released them herein.
